1. What is a work permit?

A work permit is a document that allows foreigners to work legally in Vietnam. The work permit must clearly state the following information about the employee: full name, passport number, date of birth, nationality, name and address of the organization, enterprise, workplace, and position.

2. Conditions for foreigners to be granted work permits in Vietnam

Conditions to be granted a work permit in Vietnam:

• The object of work assigned by the enterprise moves internally.
• Subjects perform contracts and agreements on economics, commerce, banking, science and technology, cultural insurance, finance, sports, education and vocational education and health.
• Provider of contractual services.
• Provider of services.
• Subjects working for foreign non-governmental organizations and international organizations in Vietnam are permitted to operate in accordance with Vietnamese law.
• Volunteers.
• Person responsible for establishing commercial presence service provision.
• Managers, executives, professionals, technical workers.
• Persons participating in the implementation of bidding packages and projects in Vietnam;
• Relatives of members of foreign representative missions in Vietnam are allowed to work in Vietnam according to the provisions of international treaties to which the Socialist Republic of Vietnam is a contracting party.

4. The process of granting work permits to foreigners

The process of granting a work permit to a foreigner consists of 2 steps.

Step 1. Approve the need to use foreign workers.

• At least 30 days from the expected date of employment of foreign workers, the employer, excluding the contractor, must send a report explaining the need to employ foreign workers to the Ministry of Labor and War Invalids and Society or to the Chairman of the Provincial People's Committee.

• Within 10 working days from the date of receipt of a valid report explaining the need to employ foreign workers, the accepting agency must issue a written approval or disapproval of the employment of foreign workers. for each job position.

Step 2. Dossier to apply for a work permit for foreigners

Documents to be prepared:

• A written request for a work permit must be made according to Form No. 11/PLI, Appendix I of Decree No. 152/2020/ND-CP.
• The health certificate or health examination certificate issued by a competent health agency or organization is valid for 12 months from the date of conclusion to the date of submission of the application file or the certificate of sufficient health. According to the regulations of the Minister of Health,
• a criminal record card or a document certifying that the foreign worker is not a person who is serving a sentence or has not yet had his criminal record cleared or is being examined for criminal liability by a foreign country or by a foreign worker. Vietnam grants within six months from the date of issuance to the date of application submission.
• Documents and papers to prove your position.
• 2 color photos of size 4cm x 6cm, white background, straight face, bare head, no colored glasses, photos taken within 06 months from the date of application.
• Written approval of the need to employ foreign workers is required, except in cases where the need to employ foreign workers is not required.
• certified copy of a passport but valid as prescribed by law.
